1. General Disclaimer

This Disclaimer governs your access to and use of Mankiwave (the "Service", "we", "us", or "our"), a cloud-hosted, multi-tenant software platform for WhatsApp marketing, CRM, AI chatbots, bulk messaging campaigns, bot building, and a shared team inbox / live chat. By accessing or using the Service, you ("User", "you", or "your") acknowledge that you have read, understood, and agree to be bound by this Disclaimer in full. If you do not agree, you must not use the Service.

This Disclaimer should be read together with our Terms & Conditions, Privacy Policy, Acceptable Use Policy, and other policies referenced throughout. In the event of any conflict, the Terms & Conditions shall prevail for matters of contractual liability.

2. No Affiliation with Meta, WhatsApp, Google, or Other Trademark Holders

Mankiwave is an independent, third-party software tool. We are NOT affiliated with, authorised by, endorsed by, sponsored by, or in any way officially connected with Meta Platforms, Inc., WhatsApp LLC, Instagram, Google LLC, Apple Inc., or any other company, platform, or trademark holder.

  • "WhatsApp", "Meta", "Instagram", "Facebook", "Google", and all related names, logos, marks, and slogans are the trademarks and registered trademarks of their respective owners. Any reference to such marks on our website, within the Service, or in our documentation is for identification and descriptive purposes only and does not imply any endorsement, partnership, or affiliation.
  • The Service is built to interoperate with WhatsApp messaging channels (including official and unofficial connection methods), but it is neither produced by, nor reviewed, certified, or supported by, Meta Platforms, Inc. or WhatsApp LLC.
  • Your use of any third-party platform (including WhatsApp, Meta, or Google services) remains subject to that platform's own terms, policies, and conditions, which you are solely responsible for reviewing and complying with.

3. "As-Is" and "As-Available" Basis

The Service is provided strictly on an "AS-IS" and "AS-AVAILABLE" basis, with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement;
  • Any warranty that the Service will be uninterrupted, timely, secure, error-free, or free of viruses, harmful components, or other defects;
  • Any warranty that defects or errors will be corrected, or that the Service, its servers, or any connected gateway will be available at any particular time or location;
  • Any warranty regarding the accuracy, reliability, completeness, or quality of any information, content, or results obtained through the Service.

No advice or information, whether oral or written, obtained from us or through the Service, shall create any warranty not expressly stated in this Disclaimer or our Terms & Conditions.

4. No Guarantee of Message Delivery, Results, or ROI

Mankiwave is a software tool that enables you to connect your own WhatsApp number(s) and message your own opted-in contacts. We do not control, operate, or guarantee the underlying messaging infrastructure of WhatsApp, Meta, or any other platform. Accordingly, we make no guarantee whatsoever regarding:

  • Message deliverability — that any message will be successfully sent, delivered, read, or received by any recipient;
  • Speed or throughput — that messages will be processed within any particular timeframe or that rate limits imposed by Meta/WhatsApp will not apply;
  • Business results — any specific outcome, sales, conversions, engagement, lead generation, revenue, return on investment (ROI), or commercial benefit from using the Service;
  • Uptime of external dependencies — the continued availability, functionality, or behaviour of any third-party API, gateway, or platform on which the Service relies.

Any examples of performance, throughput, or earnings shown anywhere in connection with the Service are illustrative only and are not promises or guarantees of results.

5. Account Restrictions, Rate-Limiting, and Bans — User Assumes All Risk

Connecting a WhatsApp number to any third-party tool, and sending bulk or marketing messages, carries inherent risk. You expressly acknowledge and accept that:

  • Meta and WhatsApp may, at their sole discretion and at any time, rate-limit, restrict, suspend, block, or permanently ban any sender number or recipient number, with or without notice;
  • Such actions are entirely outside the control of Mankiwave and frequently result from a User's own messaging behaviour, volume, content, or failure to obtain valid recipient consent;
  • We do not guarantee that your sender number will not be flagged, restricted, or banned, nor that recipient numbers you contact will remain reachable;
  • You assume all risk of account bans, number restrictions, and related losses arising from your use of the Service. Mankiwave shall not be liable for any loss of access, loss of a phone number, loss of business, or any other damage resulting from any action taken by Meta, WhatsApp, or any other platform against you.

6. Your Responsibility for Consent and Legal Compliance

You are solely and exclusively responsible for the lawful use of the Service. In particular, you are responsible for:

  • Obtaining valid, documented consent / opt-in from every recipient before messaging them, and honouring all opt-out and unsubscribe requests;
  • Complying with WhatsApp's Business Messaging Policy, Meta's commerce, business, and platform policies, and the terms of any connection method you use;
  • Complying with all applicable laws, including the Indian Information Technology Act, 2000 and rules made thereunder, TRAI / DND norms, and all applicable anti-spam, telemarketing, consumer-protection, and data-protection laws (including the GDPR, CAN-SPAM Act, and any others applicable to you or your recipients).

Mankiwave does not itself send unsolicited messages; it provides software that you operate. The legality of the content you send and the manner in which you send it is your responsibility alone. Please review our Acceptable Use Policy and Data Protection & GDPR page for further detail.

7. Not Legal, Financial, or Professional Advice

Any information, documentation, guidance, template, or content provided through the Service or on our website is for general informational purposes only and does not constitute legal, regulatory, financial, tax, compliance, or other professional advice. References to laws, policies, or compliance requirements are summaries that may be incomplete or out of date, and they are not a substitute for advice from a qualified professional. You should consult your own legal counsel and advisors before relying on any such information or before launching any messaging campaign.

8. Testimonials and Results Are Not Typical

Any testimonials, reviews, case studies, screenshots, or results described or displayed in connection with the Service reflect the individual experiences of specific Users and are not necessarily typical or representative. They are not a guarantee that you or anyone else will achieve the same or similar results. Outcomes depend on numerous factors outside our control, including your audience, offer, content, consent practices, market conditions, and platform behaviour. We do not warrant that any result, figure, or outcome can or will be replicated.

9. External Links and Third-Party Services Disclaimer

The Service and our website may contain links to, or integrations with, third-party websites, applications, payment gateways, and services that are not owned or controlled by Mankiwave. This includes, without limitation, payment processors such as Razorpay, Stripe, PayPal, PhonePe, and PayU, as well as messaging and AI platforms.

  • We do not control, endorse, or assume responsibility for the content, privacy policies, security, availability, or practices of any third-party service;
  • Accessing or using any third-party service is at your own risk and is governed by that third party's own terms and policies;
  • The inclusion of any link or integration does not imply endorsement, sponsorship, or affiliation.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Mankiwave and its owners, directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or for any account bans, number restrictions, or messaging failures, arising out of or in connection with your use of (or inability to use) the Service — whether based in contract, tort, negligence, strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
